1. Overview
Welcome to FlowStyx!
This website, www.flowstyx.com, is operated by FlowStyx Ltd, a company registered in England and Wales under company number 14852386.
Throughout these Terms of Service ("Terms"), "FlowStyx", "we", "us" and "our" refer to FlowStyx Ltd.
These Terms explain the conditions under which you may use our website, purchase our products and access related services.
By using our website or placing an order, you agree to these Terms, subject to your applicable legal rights.
Please read them alongside our Privacy Policy, Shipping Policy and Returns & Refunds Policy.
Nothing in these Terms limits or excludes any statutory consumer rights that cannot legally be restricted.
2. Using Our Website
You may browse our website without creating an account.
To place an order, you must be legally capable of entering into a purchase contract and provide accurate information, including your contact details, delivery address and payment information.
If you create an account, you are responsible for keeping your login details secure and notifying us if you suspect unauthorised access.
You agree not to use our website for unlawful activities, fraudulent transactions or actions that interfere with the website's normal operation.
Our products may be suitable for children, but purchases must be made by an adult or someone otherwise legally authorised to enter into the transaction.
3. Our Products
FlowStyx designs and produces tactile, fidget, sensory and skill toys, including our FiddleStyx range, alongside accessories, replacement parts and other related products.
We take reasonable care to ensure that product descriptions, images, specifications and prices are accurate.
However, minor differences in colour or appearance may occur because of lighting, photography, display settings and variations in production.
For UV-reactive products, the appearance under ultraviolet lighting may differ from their appearance in normal daylight.
We aim to represent these differences clearly in our product information.
Products are supplied according to the descriptions and specifications provided at the time of purchase.
We may introduce, modify or discontinue products and colourways, but changes to our catalogue will not alter an already accepted order without your agreement or another lawful basis.
4. Product Safety and Responsible Use
Products must be used in accordance with their descriptions, age recommendations, warnings and any safety instructions supplied.
Standard FiddleStyx are intended for ages 3 and over, although other products may have different suitability requirements.
Children should be supervised where appropriate to their age and abilities.
Customers should inspect products for damage before use and stop using any product that appears unsafe.
FiddleStyx are designed for handheld fidgeting, sensory play and trick practice. They should not be deliberately used to strike people, animals or objects, or in ways that create an unreasonable risk of injury.
Some of our products contain detachable or replaceable components. Please ensure all components are securely fitted before use.
Nothing in this section excludes our responsibility for supplying products that meet applicable legal safety requirements.
5. Orders and Contract Formation
When you place an order through our website, you are making an offer to purchase the selected products.
We will normally send an automated order confirmation acknowledging your purchase. This confirmation does not necessarily mean we have accepted the order.
A purchase contract is formed when we confirm acceptance of your order, normally through a dispatch confirmation or another express acceptance.
We may be unable to accept an order for legitimate reasons, including:
-
A product becoming unavailable.
-
An obvious pricing or listing error.
-
An inability to deliver to the requested destination.
-
A payment authorisation problem.
-
Reasonable concerns about fraud or unlawful activity.
If we cannot fulfil an order, we will contact you and refund any payment taken for the unfulfilled goods.
We will not substitute products or increase the agreed price without your consent.
If you need to amend an order, please contact support@flowstyx.com as soon as possible.
We will try to accommodate requests where practical, but changes may not be possible once an order has been dispatched.
Your statutory cancellation and refund rights remain unaffected.
6. Prices, Discounts and Promotions
Prices are displayed in the currency selected or shown on our website.
The total price payable, including applicable taxes and any delivery charges payable through checkout, will be shown before you submit your order.
Prices and promotional offers may change over time. However, changes will not retrospectively increase the price of an order that we have already accepted.
We occasionally offer promotional discounts, quantity-based savings, bundles and other special offers.
Promotions may be subject to additional conditions, such as minimum order quantities, qualifying products or promotional deadlines. These conditions will be disclosed alongside the relevant offer.
Discounts and promotional codes may not be combined unless expressly stated. Where discounts cannot be combined, checkout will determine which eligible offer applies under the published promotional conditions.
The total displayed before you confirm your purchase will reflect the applicable discounts.
If you believe a promotion has been applied incorrectly, please contact support@flowstyx.com before placing your order.
We reserve the right to correct genuine pricing errors and withdraw promotions prospectively, subject to applicable consumer law.
7. Payments
Payments are processed securely using the payment methods offered at checkout.
Depending on your location and eligibility, payment options may include card payments, accelerated checkout services or third-party instalment providers.
Where a third-party payment provider is used, its additional terms may apply.
Any finance or instalment agreement is separate from your purchase contract with FlowStyx, except where applicable law provides otherwise.
We do not require customers to disclose their full payment card details directly to us by email.
You confirm that you are authorised to use the payment method selected.
If a payment cannot be authorised or completed, we may be unable to process the order.
8. Shipping and Delivery
We offer delivery to the United Kingdom and a range of international destinations.
Orders typically dispatch within 1–3 working days, unless a different processing time is stated for a particular product.
Delivery times are estimates and depend on the destination, shipping service, customs processing and other relevant circumstances.
The delivery charges and available shipping services will be displayed at checkout.
Our Shipping Policy provides additional information about dispatch, delivery estimates and international shipping.
We are responsible for delivering consumer purchases in accordance with applicable law.
For UK consumer purchases, products normally remain at our risk until they come into your physical possession or that of a person you have nominated to receive them.
An exception may apply where you independently arrange a carrier that we did not offer as a delivery option.
If a parcel is lost, significantly delayed or arrives damaged, please contact support@flowstyx.com so we can investigate and arrange an appropriate resolution.
Your statutory rights concerning delivery remain unaffected.
9. International Orders, Duties and Taxes
International orders may be subject to customs procedures, import duties or local taxes depending on the destination and delivery arrangement.
Where duties or taxes are collected or included as part of your checkout and shipping arrangement, this will be reflected in the relevant purchase information.
Where additional charges may be payable on import, responsibility for those charges will depend on the delivery terms disclosed before purchase and applicable law.
We recommend reviewing the shipping and customs information shown at checkout before completing an international order.
If you have questions about an international purchase, please contact support@flowstyx.com.
10. Returns, Cancellations and Refunds
We want you to enjoy your FlowStyx purchase.
If you change your mind, eligible online consumer purchases can normally be cancelled within 14 days of receiving the goods, subject to applicable legal exceptions.
Customers who exercise their cancellation rights must then return the goods within the applicable return period.
Products that are faulty, damaged, not as described or otherwise fail to meet applicable legal requirements are covered by separate statutory protections.
Our Returns & Refunds Policy explains:
-
How to cancel or return an order.
-
Refund processing and timescales.
-
Return postage responsibilities.
-
Faulty or damaged products.
-
Exchanges and replacement parts.
-
Rules that may apply to genuinely bespoke or personalised products.
To request assistance, email support@flowstyx.com.
Nothing in these Terms or our Returns & Refunds Policy removes or restricts your statutory consumer rights.
11. Wholesale and Business Orders
FlowStyx supplies products to both individual consumers and commercial retailers.
Retailers may purchase products for resale through authorised wholesale arrangements, including direct trade orders and approved wholesale platforms.
Wholesale purchases are permitted and are not prohibited by the personal-use provisions of these Terms.
Business-to-business orders may be subject to separate terms covering wholesale pricing, minimum order quantities, payment terms, delivery arrangements and other trade conditions.
Where separate wholesale terms have been expressly agreed, those terms will take precedence for the relevant commercial transaction to the extent permitted by law.
Consumer cancellation rights do not automatically apply to purchases made wholly for business purposes.
For wholesale enquiries, contact wholesaling@flowstyx.com or visit our Faire Direct shop.
12. Intellectual Property
The FlowStyx website, branding, product designs, photographs, videos, illustrations, written materials and other original content are protected by applicable intellectual property laws.
These rights may include copyright, trade marks, registered designs, unregistered design rights and other relevant protections.
Unless otherwise stated, the relevant rights belong to FlowStyx Ltd or are used with permission from their respective owners.
You may view and use our website for lawful personal browsing and shopping.
You must not reproduce, manufacture, copy, distribute or commercially exploit protected FlowStyx product designs or original content without the necessary permission or another lawful basis.
You must not use our branding, logos or marketing materials in a way that falsely suggests an endorsement or commercial relationship.
Authorised retailers, affiliates and collaborators may use approved FlowStyx promotional materials in accordance with their separate agreements or permissions.
Nothing in these Terms limits any lawful use permitted by intellectual property legislation.
For licensing, product collaborations or commercial permissions, contact hello@flowstyx.com.
13. Third-Party Services and Shopify
Our website is powered by Shopify, which provides ecommerce technology supporting our online store.
Products purchased directly from the FlowStyx website are sold by FlowStyx Ltd, not Shopify.
Shopify and other service providers may process information or facilitate payments, delivery, reviews or other website functions in accordance with their applicable terms and privacy notices.
We may also link to external websites, including social media platforms, payment providers, wholesale marketplaces and other third-party services.
We are not responsible for independently operated third-party websites or services outside our control.
However, using third-party providers does not remove any legal responsibility we have for goods or services supplied to you.
14. Privacy and Personal Information
We respect your privacy and handle personal information in accordance with applicable data protection law.
Our Privacy Policy explains how personal information may be collected, used, stored and shared, including information processed through Shopify and other service providers.
Please review that policy for details of your data protection rights and how to contact us about personal information.
15. Reviews, Feedback and Customer Content
We welcome feedback, photographs, videos, reviews and suggestions from our customers.
If you voluntarily submit content for public display on our website or through an official review feature, you confirm that you have the right to share it.
You grant us a non-exclusive, royalty-free licence to reproduce, display and format that content as reasonably necessary to operate the relevant review, community or promotional feature.
You retain ownership of your original content.
Where additional permission is legally required to use customer-created content in advertising or other promotional materials, we will seek that permission.
Reviews must reflect genuine experiences. Any material connection, incentive or compensation associated with a review must be disclosed where required by law.
We may moderate or remove unlawful, misleading, abusive or otherwise inappropriate content in accordance with applicable law.
We will not knowingly present fabricated reviews as genuine customer feedback.
16. Website Availability and Accuracy
We work to maintain an accurate and accessible website, but occasional technical interruptions, typographical errors or display issues may occur.
We may update website information, correct errors or perform maintenance when reasonably necessary.
We cannot guarantee that every website function will be uninterrupted or free from technical problems.
However, we remain responsible for meeting our legal and contractual obligations relating to accepted orders.
If you encounter a technical issue affecting an order, payment or promotion, please contact support@flowstyx.com.
17. Prohibited Activities
You must not use our website to:
-
Commit fraud or engage in unlawful activity.
-
Attempt unauthorised access to accounts, systems or customer information.
-
Distribute malware or malicious code.
-
Interfere with the security, availability or normal operation of the website.
-
Harass, threaten or impersonate another person.
-
Submit knowingly false or misleading information.
-
Infringe intellectual property or privacy rights.
-
Conduct unauthorised commercial data extraction that infringes applicable rights or disrupts the website.
Legitimate use of assistive technologies, search engines and authorised shopping or browsing tools is permitted, provided these tools do not circumvent security measures or interfere with our services.
We may take proportionate action to restrict harmful or unlawful activity, including suspending access where reasonably necessary.
18. Liability and Consumer Rights
We are responsible for losses caused by our breach of these Terms or failure to exercise reasonable care and skill where applicable law makes us responsible.
Nothing in these Terms excludes or limits liability for:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of statutory consumer rights relating to goods.
-
Any other liability that cannot lawfully be excluded or restricted.
We are not responsible for losses that are not caused by our breach, are not reasonably foreseeable, or result solely from circumstances outside our reasonable control where applicable law permits that limitation.
Where you purchase products as a consumer, we do not generally accept responsibility for business losses arising from commercial use, except where the law requires otherwise.
Separate liability provisions may apply to business-to-business orders under expressly agreed wholesale terms.
Nothing in this section prevents you from exercising any legal remedy available to you.
19. Events Outside Our Reasonable Control
Occasionally, circumstances outside our reasonable control may affect our ability to fulfil an order.
Examples may include severe weather, major transport disruption, industrial action, natural disasters or significant interruptions to essential services.
If such circumstances affect your order, we will take reasonable steps to inform you and minimise the disruption.
We will continue to respect your applicable rights concerning delayed delivery, cancellation and refunds.
20. Suspension or Termination of Website Access
We may suspend or restrict website accounts or access where reasonably necessary to prevent fraud, protect security or address serious breaches of these Terms.
We will act proportionately and, where appropriate, provide an explanation.
Suspending website access does not automatically cancel an accepted purchase contract or remove any outstanding rights or obligations relating to an order.
21. Changes to These Terms
We may update these Terms to reflect changes to our business, website, services or applicable legal requirements.
The latest version will be available on this page, together with its last-updated date.
Where changes materially affect existing customers or contracts, we will provide notice where required by law.
Changes will not retrospectively remove rights or alter the agreed terms of an accepted order without a lawful basis.
22. Governing Law and Disputes
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in your country of residence.
If you are a consumer, nothing in these Terms prevents you from bringing proceedings in a court that has jurisdiction under applicable consumer protection law.
If a problem arises, we encourage you to contact us first so we can try to resolve it promptly and fairly.
For order-related concerns or complaints, email support@flowstyx.com.
For general questions about these Terms, email hello@flowstyx.com.
23. General Provisions
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply where legally possible.
Our decision not to enforce a provision on a particular occasion does not automatically prevent us from enforcing it later.
These Terms, together with the policies and any additional conditions expressly incorporated into an order, describe the relevant contractual arrangements between you and FlowStyx.
They do not override any statutory rights or any additional representations or information that applicable law makes binding.
Section headings are provided for convenience and do not alter the meaning of the Terms.
